The situation
A second-generation family business ran a food manufacturing operation in regional Victoria. As it expanded into export markets, it needed an experienced production manager with food safety and quality systems expertise. For more than six months, it advertised the role locally without finding a suitable candidate.
Through industry contacts, the business found a qualified production manager in Malaysia with over ten years' experience in a similar facility. The owners were keen to bring him on board, but they had never sponsored a worker before. They were unsure which visa to use, whether their advertising met the requirements, and what ongoing obligations they would take on as a sponsor. The candidate also wanted to know whether he and his family could eventually settle in Australia permanently.
Our approach
We began by understanding the role, the business and its plans for the next five years. We then compared the main options. These included the Skills in Demand visa (subclass 482), the regional employer-sponsored visa (subclass 494), and whether a Designated Area Migration Agreement applied in the region. For each option, we explained the occupation and salary requirements, labour market testing, costs, processing times and the pathway to permanent residence.
The business chose the regional pathway, which suited its location and offered the candidate a route to permanent residence. We reviewed its earlier advertising and advised on the additional steps needed to meet the labour market testing rules. We then prepared the business's sponsorship application, the nomination showing that the position was genuine and met the salary requirements, and the candidate's visa application, including his skills, English, health and character evidence, with his wife and children included.
Before the visa was granted, we explained the business's ongoing sponsor obligations in plain terms. We also helped it set up simple records for salary, duties and reporting, so it could stay compliant from the first day.
The outcome
In this illustrative example, the business has a clear, compliant pathway to bring in the specialist skills it needs, and an understanding of its obligations as a sponsor. The production manager and his family have a plan to relocate to regional Victoria, with a pathway towards permanent residence if he meets the requirements. The business is also better placed to sponsor future staff as it continues to grow.
This is an illustrative example based on common situations. It is not an account of a specific client's matter. Every case is different, and past results do not guarantee a particular outcome. Visa requirements change regularly. For advice about your business, please contact us.
